Hugues Villey, a partner, and Lucile Delahaye, an associate, in the Competition, Distribution and Contracts department, published an article in “LJA” entitled: “The French Competition Authority confirms and clarifies the conditions under which the head of a network can control the online sale of its products.”
In Decision 20-D-20 of 3 December 2020, the French Competition Authority reaffirmed the principle prohibiting suppliers from restricting the pricing freedom of their online distributors, but approved their right to prohibit the resale of products on third party online platforms.
